The Contract and Commercial Law Act 2017 (Act), which took effect on 1 September, repackages and updates 11 pieces of legislation, including the Contractual Remedies Act 1979, Illegal Contracts Act 1970 and Sale of Goods Act 1908. Given the magnitude of the Act, timely guidance about its contents and effect will be useful for lawyers and their clients.

Learning outcomes:

  • Get to grips with the key changes made by the Contract and Commercial Law Act 2017 – and also ascertain which pieces of legislation have not been subsumed.
  • Gain a deeper understanding of what lawyers and their clients will need to do, by 1 September, as a result of the Act – such as updating templates and contracts, and ensuring consistency and sense are achieved.
  • Receive an update and refresher on how the Act relates to and will impact on contract drafting.

Who should view?

Junior to intermediate commercial lawyers and general practitioners who do some commercial work. More experienced practitioners may also wish to attend for an update and refresher.

Mike is based in the Law school at the Auckland University of Technology where has teaches in the areas of private law obligations and remedies.  

Mike is pleased he completed his undergraduate law degree at Victoria University before the Contractual Mistakes Act and other subsequent related legislation was enacted because this has been very beneficial in helping him to explain the significance of the various statutory provisions to students over the years.   

After completing his master’s degree Mike headed to the UK in 1979 for a stint of OE and ended up spending over 20 years teaching law at the University of Greenwich in London.  

Returning to NZ in 2002, Mike led the development of the AUT law degree which enrolled its first cohort of students in 2009 – Mike has the distinction of being instrumental in establishing law schools in both hemispheres, having been part of the team which set up the law school at Greenwich in 1990.
