Auckland District Law Society – Library by-laws

- Only the following persons may use the Society's libraries and their equipment and books:
a) legal practitioners holding a current practising certificate in New Zealand or Australia;
b) Judges and retired Judges of any New Zealand Court or Federal Court of Australia;
c) Associate Judges and retired Associate Judges and Masters;
d) Registrars and Deputy Registrars of the High Court and of the District Court;
e) staff of members of Auckland District Law Society and staff of the Judiciary, for the purposes of their employers;
f) members of the Faculty of Law at the University of Auckland;
g) Associate Members of ADLS.
h) such other persons as the Council, the Library Committee, the Executive Director or the Librarian may, from time to time, authorise to use the libraries subject to the payment of such fees and to such conditions as may from time to time be imposed.
- HC Auckland Library security system
a) The books in the Auckland HC Library have been security tagged and will set off alarms if users attempt to remove them from the Library. At the Parliament St entrance, library staff will approach users who set off the alarm, and at the Anzac Avenue door, the alarm will trigger a video camera. This video will be viewed by the Librarian or representative and the member will be contacted.
b) Members may not give access to unauthorized people (see (1) above).
- Borrowing from the libraries:
Auckland High Court Library
Books may be borrowed from the Library only with the express approval of the Librarian or representative, on the condition that:
a) the borrower signs them out in the appropriate way;
b) they are returned to the Library immediately after they are no longer required.
Branch libraries
Books may be borrowed from the libraries for use in the courtrooms or Judges' chambers of the court to which the Library is annexed.
- Rare books
The rare books collection is subject to the conditions set out in the ADLS Library and Research Centre Resources Policy.
- Holding library materials for use in the Library or in court
a) Books may be set aside when required in court. Such books shall be left with a marker showing the date of setting aside and the name of the member setting them aside. Such books not in use on the third day after the setting aside may be returned to the shelves.
b) Those members who have need of collections of library materials for longer periods, for example writers of textbooks, should refer to the "Guidelines for textbook writers in the ADLS Library".
- Library materials and equipment
shall always be treated with care and with consideration for others who may be waiting to use them.
- Books no longer required
shall be left on the trolleys provided in the Auckland High Court Library. In the other libraries, users shall reshelve books.
- All users of the libraries are expected to show courtesy to and consideration for other users and staff.
No talking in the libraries shall be permitted when it interrupts or disturbs persons reading or studying. Mobile telephones and pagers are to be turned off, except in library carrels.
- Internet access in the libraries
Library machines may not be used to access any site which is unlawful, pornographic or offensive in any way.
- Cards or keys to the libraries
supplied to members of the Society are the responsibility of members and care must be taken to ensure that they are not lost and are not given to persons with no right of admission to the libraries.
- Library staff
will provide general assistance and guidance to members at no charge. Members who request the provision of charged services - research, document delivery, training - will be invoiced at the rates currently in force.
- Members of the Society whose credit is restricted by the Society
will not be offered the following services by the Library:
a) after-hours access (cards will be temporarily disabled);
b) hire of gowns other than for cash payment of charges in advance;
c) photocopying (PINs will be temporarily disabled);
d) research and document delivery, other than for cash payment of charges in advance.
- Members of the Society who wish to send their staff to use the libraries on their behalf
shall ensure that the staff are adequately instructed in the use of the Library before they are sent. The library staff will assist with training on a charged basis if required.
- The Librarian shall report any breach of these by-laws
to the Convenor of the Library Committee who may report such breach to the Council for such action as the Council sees fit.
- A breach of these by-laws
shall be a breach of the Rules of the Society.
